RELEASE, INDEMNITY AND WAIVER OF ALL CLAIMS

CONSENT TO USE OF NAME, IMAGE, and Likeness

EVENT NAME: Michelin Ride Day (Strait Acres Showdown)

EVENT LOCATION: Ride Rock Creek, Zirconia, North Carolina

EVENT DATE(S): September 11, 2025

The UNDERSIGNED PARTICIPANT acknowledges that participation in the Michelin Ride Day (Strait Acres Showdown)(“Event”), at Ride Rock Creek in Zirconia, North Carolina (“Event Location”), which participation may occur in various ways on and off a bicycle and may include potentially hazardous and/or strenuous physical activities (including, but not limited to, riding a bicycle), transportation between venues, photograph and/or film of the Event, bystander observing the Event or involved for any purpose in Event activities, and/or otherwise entering the areas where Event activities take place. This Release, Indemnity and Waiver of All Claims (“Release”) covers any and all participation in and/or viewing of the Event during which Participant may sustain injuries to person and/or property, including death.

The undersigned Participant certifies that he/she is at least eighteen (18) years of age, has full authority to execute this Release, and has the necessary skills, physical condition, and good judgment to allow him/her safely to participate in the Event. If Participant is a minor under 18 years of age, then signature of parent or legal guardian is required.

For and in consideration of the opportunity to participate in the Event, the Participant (hereinafter “Releasor”), individually and for his/her heirs, executors, administrators, successors and assigns, does hereby release, discharge and agree to defend, indemnify and hold harmless Michelin North America, Inc. (“Michelin”) and all of its respective licensees, affiliates, successors, assigns, employees, officers and directors (collectively, “Releasees”), without any limitation, exception, reservation or exclusion, from and against any and all claims, losses, damages or actions whatsoever, including attorneys’ fees, for injury to person or property, including death, arising out of, related to, or occurring as a result of Releasor’s access to and/or participation in the Event.

This Release is governed by the laws of the State of South Carolina. Releasor expressly agrees that this Release is intended to be as broad and inclusive as permitted by law, and if any portion hereof is deemed to be against public policy or otherwise unenforceable, the remainder shall continue in full legal force and effect.

In addition, the undersigned Participant/Releasor does hereby give Michelin, its agents, parents, affiliated companies, successors and assigns, and its and their officers, directors, employees, agents and representatives, and those acting under its permission or upon its authority, the unqualified right and permission to reproduce, copyright, publish, circulate, or otherwise use recordings and reproductions of Participant’s name, image, likeness, and/or voice without any further compensation to Participant. Recordings may consist of audio, video, still photography, or any combination thereof. Participant acknowledges and understands that a recording may be used for “broadcast” across the Internet as well as for traditional forms of broadcasting (radio or television) or through the distribution of recorded media (CD, DVD, etc.).

In addition, Participant/Releasor grants Michelin full permission to publish, advertise, copyright, and use in any way, commercially or otherwise, any or all testimonials, endorsements or statements by Participant, with or without changes in or additions to the same, and either with or without my name, in connection with any of the above. Also, Participant/Releasor waives and releases any and all claims he/she might have for invasion of privacy, or otherwise, for anything which Michelin does under or in reliance on the foregoing permissions. Participant/Releasor understands that he/she will receive no compensation for any recording.

I HAVE READ THE FOREGOING RELEASE, INDEMNITY AND WAIVER OF ALL CLAIMS AND FULLY UNDERSTAND IT IS A RELEASE OF LIABLITY AND WAIVER OF TIGHTS. I FURTHER CCERTIFY THAT I HAVE READ AND AGREE TO THE CONSENT TO USE MY NAME, IMAGE, AND LIKENESS. I EXECUTE THIS RELESE AND CONSENT VOLUNTARILY AND WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE. I FURTHER CERTIFY I AM NOT RELYING ON ANY STATEMENTS OR REPRESENTATIONS OF MICHELIN AND/OR OTHER PARTIES RELEASED IN THIS RELEASE. I HAD THE OPPORTUNITY TO SEEK LEGAL COUNSEL FOR THIS DOCUMENT AND HAVE WAIVED THAT RIGHT.
